Terms of use

The rules for using this website. Working with us is covered by a separate written agreement.

Last updated [Date]Template under German law

Scope

These terms apply to your use of the website at vanta.so (the “website”), operated by [Company name] [Legal form, e.g. GmbH], [Street and number], [Postal code and city], [Country] (“we”, “us”). By using the website you accept these terms. Our full company details are in the imprint.

Conflicting terms of users do not apply unless we agree to them in writing.

Adults only

The website is intended exclusively for people aged 18 or older. Our services relate to the adult creator industry. If you are under 18, you may not use the website or apply.

Before any collaboration we verify the age and identity of every creator [how: e.g. a check of a government-issued ID by a named team member or a verification provider]. Applications from anyone who cannot prove they are an adult are rejected, and the data they submitted is deleted [when: e.g. immediately after the decision].

Drafting note: Not yet confirmed by the founder. Keep this paragraph only if it describes what the agency actually does: confirm the age and identity verification process, who carries it out, and when the data of rejected applicants is deleted (it must match “How long we keep data” in the privacy policy).

The website itself shows no explicit content.

No offer of services

The content of the website is general information about us and the services we provide. It is not a binding offer and does not create a contract.

Submitting an application is a non-binding request to get in touch. It creates no obligation for you or for us, and we may decline an application without giving reasons. A collaboration only begins once both sides have signed a written management agreement, whose terms then apply.

Figures and examples

Figures on the website, such as revenue, growth or reply times, describe past results or examples. They are not a promise or guarantee of future earnings. What a creator earns depends on many factors, including their content, audience and the platforms they use.

Drafting note: State the source and period behind every figure shown on the marketing pages, for example: “Figures based on [source] for [period].”

Your application

When you apply, you agree to:

  • provide truthful and complete information;
  • only apply for yourself, and not submit data about other people without their permission;
  • not upload or send photos, identity documents or explicit content through the form.

How we handle the data you send is explained in our privacy policy.

Acceptable use

You may not:

  • use the website in a way that breaks the law or the rights of others;
  • attempt to gain unauthorised access to the website, its servers or connected systems;
  • disrupt or overload the website, or test it for vulnerabilities without our written permission;
  • scrape, copy or systematically collect content from the website by automated means.

Internal tool

The team sign-in and the management dashboard behind it are for authorised members of our team only. Any other access is prohibited. Access is logged, and attempts at unauthorised access may be reported to the authorities.

Intellectual property

The website, its design, text, graphics and software are protected by copyright and other rights and belong to us or our licensors. You may view the website and print or save pages for your own personal use. Any other use requires our prior written consent. Names and marks of third-party platforms belong to their owners; we are not affiliated with or endorsed by them unless stated.

The website may link to websites of third parties. We have no influence on their content and are not responsible for it. The imprint explains how we handle links.

Liability

The website is provided free of charge. We are liable without limitation:

  • for intent and gross negligence;
  • for injury to life, body or health;
  • under the German Product Liability Act (Produkthaftungsgesetz);
  • where we have given a guarantee.

For slight negligence we are only liable if we breach an obligation that is essential for the purpose of using the website and on which you may regularly rely (a cardinal obligation). In that case our liability is limited to the damage that was foreseeable and typical when the breach occurred. Otherwise, liability for slight negligence is excluded.

We do not guarantee that the website is always available or free of errors. These limits also apply to the personal liability of our employees, representatives and agents.

Drafting note: Standard German liability clause for a free website. Have counsel check it against § 309 No. 7 BGB and adapt it if the website ever offers paid services or accounts.

Changes to these terms

We may update these terms for the future, for example when the website changes or the law requires it. The version published on this page when you use the website applies.

Applicable law and jurisdiction

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you use the website as a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the country where you habitually reside.

If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from these terms is [City of the company’s registered office].

Severability

If any provision of these terms is or becomes invalid, the remaining provisions stay in effect. The invalid provision is replaced by the statutory rules.
